It is a pity that the question about the proper purpose of law has so often been formulated in terms of ‘the enforcement of morals’. Not only is that issue highly charged with emotion, but the sense of the expression is unclear and, taken in any ordinary sense, its importance is marginal. What Lord Devlin seems chiefly to be arguing, when he supports the enforcement of morals, is that there are in any society certain central institutions which receive and deserve (...) protection by law and that without such protection the society in question would disintegrate. His examples in our own society are monogamy and private property. It is true that these institutions are closely bound up with parts of our morality in two different ways: certain moral prohibitions are defined in terms of them, e.g. adultery and theft; a host of obligations is associated with them upon whose general acceptance and discharge their continuance depends. But it is only in an extended sense that one could describe the institutions themselves as parts of the common morality. It is possible, therefore, to hold that the law may properly be used to protect such institutions without necessarily taking the further step of maintaining that their protection requires and justifies legal prohibition of acts which offend against the associated morality. Professor Hart states this position clearly : ‘What is essential and to be preserved is the essential core. On this footing it would be an open and empirical question whether any particular moral rule or veto, e.g. on homosexuality, adultery or fornication, is so organically connected with the central core that its maintenance and preservation is required as a vital outwork or bastion.’. For Michel Henry, the Cartesian notion of “videre videor” (“I seem to see”) provides the clearest schema of the type of self-affection in which life is experienced, and through which one can provide a properly phenomenological conception of life. It is above all in Henry’s exemplification of the ‘videor’ in terms of affective experience (in undergoing a passion, feeling pain) that one is able to pin down his two principle arguments concerning the nature of this self-affection. The one, (...) regarding the videor as a form of self-awareness, ultimately fails to convince, whereas the same cannot be said for Henry’s analyses of those types of affective experience whose primary characteristic is precisely a form of resistance internal to life itself. This leads to a demonstration of how Henry’s phenomenology of the videor founds an understanding of life that presupposes a form of impotence and limitation, and even finitude, as the very implication of its appearance. Kierkegaard steadily maintains, against Lessing, that Jesus’s contemporaries had no advantage as regards faith merely because they had personal experience of him. It is a view proposed both by Johannes Climacus and Anti-Climacus, as well as over Kierkegaard’s own signature; it is indirectly communicated and then directly communicated, and so the importance of becoming a true contemporary of Jesus can hardly be underestimated in the authorship, including the later journals. When Michel Henry considers this motif in his Phénoménologie matérielle (...) he says that it is one feature of what Kierkegaard calls “’the strange acoustics of the spiritual world’ [l’étrange acoustique du monde spirituel].” These acoustics are not those we learn about in physics: “the laws of being in common are not in fact those belonging to things and the laws of perception,” and this claim gives Henry an opportunity to continue a long standing argument with Husserl. For “here” and “there” in Henry’s account of inter-subjectivity have no relation to the intersubjectivity that is explored in the fifth of the Cartesian Meditations. Indeed, Henry goes on to say, “This spiritual acoustics, which defies the laws of perception, defines our concrete relation to the other”; that is, it gives the “how” of the relation rather than the “what” or “why.”. In this thought-provoking book, David Hart challenges the creation myth of post--World War II federal science and technology policy. According to this myth, the postwar policy sprang full-blown from the mind of Vannevar Bush in the form of Science, the Endless Frontier. Hart puts Bush's efforts in a larger historical and political context, demonstrating in the process that Bush was but one of many contributors to this complex policy and not necessarily the most successful one. Herbert Hoover, Karl (...) Compton, Thurman Arnold, Henry Wallace, Robert Taft, and Curtis LeMay--along with more familiar figures like Bush--are among those whose endeavors he traces.Hart places these policy entrepreneurs in the broad scheme of American political development, connecting each one's vision of the state in this apparently esoteric policy area to the central issues, events, and figures of mid-century America and to key theoretical debates. Hart's work reveals the wide range of ideas, often in conflict with one another, that underlay what later observers interpreted as a "postwar consensus." In Hart's view, these visions--and the interests and institutions that shape their translation into public policy--form the enduring basis of American politics in this important area. The early modern play Sir Thomas More, written by Anthony Munday, Henry Chettle, Thomas Dekker, Thomas Heywood, and William Shakespeare, takes an ecumenical viewpoint of the play's Catholic hero in order to conform to the expectations of the Master of the Revels and to appeal to a cross-confessional audience. The playwrights carefully construct the play within the confines of censorship by centering the play's action around More's dynamic personality instead of giving a full exposition of historical plot. More's personality (...) and famous wit function together as a means for diverting attention away from the controversy surrounding More's silent opposition to Henrician policy while subtly validating his martyrdom. The argument of this article examines the adaptation of the play's ideologically diverse source material, the playwrights’ use of martyrological conventions, and the subtle traces of Erasmian allusion and recusant rhetoric in its reading of the play. I just returned from a small conference attended by Basil Hiley, among a pestigious group of 17. An Oxford Philosopher of Science, S. Saunders, asserted strongly a point that I have often made, namely that the theory has never been extended to the relativistic case involving particle creation. Hiley did not disagree, but I believe admitted that this was indeed the case. So that is one reason why the theory as it stands is inadequate.

Reading Kevin Hart’s creative hermeneutic of the ‘basileic’ reduction in his latest book, Kingdoms of God, naturally leads me to consider another eminent linguistic phenomenologist who continually occupies my thoughts. Although I have been reading Hart now for about 25 years, I have been reading Paul Ricoeur for a decade longer than that, and it is his theory of poetic discourse that my mind keeps tenaciously associating with Hart’s perspectives on parable. Granted, Hart never mentions Ricoeur (...) in Kingdoms of God—unless my careful reading is not so careful and I missed it! In Trespass of the Sign, however, he does note Ricoeur’s significance as a hermeneutical philosopher, specifically his emphasis on the distinction between the hermeneutics of faith and the hermeneutics of suspicion. Also, in an article on John Caputo’s postsecular philosophy of ‘religion without religion,’ Hart makes a brief comment on Ricoeur’s apparent Hegelianism with reference to a general theory of revelation as nonreligious and nontheistic. Still, nowhere that I know of does he extensively address Ricoeur’s fascinating discourse theory regarding metaphor, mimesis, narrative, and parable. If great minds think alike, then Hart and Ricoeur are, indeed, great minds, for, truly, Ricoeur’s reflections on parables and the Kingdom offer an intriguing gloss on Hart’s parabolic ‘basileiology.’ Translating Hart into Ricoeur, therefore, is, in my mind, an easy and profitable exercise that may well enhance the provocative character of Hart’s basileic reduction. Such a translation is the central purpose of this essay. (shrink)

In between the time of John Austin and H.L.A. Hart a great legacy, and an accompanying debate, spawned out of the work of Sir ­Henry Maine. While employing a primarily comparative, historical perspective, Maine sought to scrutinize and redefine the way philosophy relates to the social sciences within jurisprudential enquiries. From this perspective, the present paper aims to reclaim and represent Maine’s work as a project in and for the philosophy of law. A project which came to inspire (...) and influence future generations of philosophers, and two subsequent schools of thought, by instigating a forgotten debate around the concept of custom, its relation to the concept law, and the status of customary law. This examination will close with a note, highlighting certain aspects the revival of Maine’s works, as well as the legacy which spawned out of them, can have generally for the philosophy of law and interdisciplinary jurisprudence, as well as more particularly for the philosophy of customary international law. KNASAS Henry VIII and the Conforming Catholics. By PAUL O'GRADY. Collegeville, Minnesota: The Liturgical Press, 1990. Pp. 186. $11.95 (paper). The careers and writings of what this author has (...) called " Conforming Catholics " have been generally neglected by historians of the English Reformation, at least until recently. That is why it is even more remarkable that not only one, but two books should be published in 1990 on this subject. Glyn Redworth's life of Stephen Gardiner, bishop of Winchester (Jn Defense of the Church Catholic, London: Basil Blackwell) is primarily a historical and biographical account of this pivotal anti-papal Catholic, with particular emphasis on the period from 1540-1547. This book, while complete and well written, concentrated on the life of Bishop Gardiner almost to the exclusion of his writings, though some of these were mentioned in passing. Paul O'Grady's book suffers from almost the reverse of that problem. In his Introduction, he contends that " intellectual systems, once generated, have a logic of their own." His concentration on the " intellectual system " of anti-papal Catholicism at times overwhelms the historical considerations of the period, and he falls into at least the neglect of what Professor Geoffrey Elton calls " uncertainty as to what actually happened." Dates are plentiful in this consideration, to be sure, but the events selected are limited, and one gets the impression that there is quite a bit more to the story than the author is letting on. Quite a bit of familiarity with the period is assumed by the author on the part of the reader, and much that is quite germane to the topic and useful to following the text is relegated to footnotes. The great contribution of this study is that it raises a number of names to a higher profile, and highlights their writings. Gardiner, though relatively neglected (at least until recently), is one of the few names that surface about which a biography has been written. There has been a significant amount of groundwork done for this book, and merely the listing of titles by these authors is a valuable contribution. But there are problems, some of which are hardly the fault of the author. O'Grady uses the term "Henrician Catholic" in a number of BOOK REVIEWS 157 places, which causes one to wonder, what was the Catholicism of Henry VIII himself? J. J. Scarisbrick, in his magisterial biography of the king, certainly goes over the evidence, and O'Grady adds nothing new. The sources are scanty, and one is forced at times to make a series of assumptions (based on Henry's choice of bishops and councilors, for example) about what Henry actually believed that eventually become a series of assumptions piled on top of other assumptions. Noticeably and significantly absent from the consideration of Henry's management of his ecclesiastics is any attention to Henry's plan for the formation of a strong Tudor monarchy within England, the long standing work of Professor Elton. Foreign policy, another issue in the religious settlement of the period, is mentioned occasionally and briefly (here Professor Redworth's book more than makes up the difference). One cannot attempt to determine the king's theological positions in a vacuum, and although Henry VIII did (and still does) have some reputation as an " amateur theologian " in the period in question, there are few purely theological statements by that monarch. Theology, to all appearances, was just one lever used by Henry in erecting a strong modern state: the imposition of theological and liturgical uniformity was almost always a means to political uniformity, as the Prayer Book Revolts in Cornwall and the West showed in Edward's reign. Another problem arises in determining who, exactly, is an Henrician Catholic? It is fairly simple to differentiate this group from the Reformers -the controversies over the Sacrament and justification by faith do this clearly. But how can they he separated from the Roman Catholics? O'Grady... (shrink)

David Bentley Hart and Jordan Daniel Wood are part of a movement aiming to overcome any separation between divine and human nature, avoiding what they see as a problematic account of grace. As opposed to radical kenoticism which holds that God only exists or has a given character in relation to creation, Hart and Wood appeal to facts about God such that He could not act otherwise towards human beings, given His character. They thereby ground conclusions that God (...) could not fail to create and that human beings could not be otherwise than divinized. Even though they differ on what it is in virtue of the fact that God could not act otherwise, both authors rest their views on such claims. I will argue such views involve serious theological and metaphysical problems, because this strategy entails – as much as radical kenoticism – that God is constituted by His relation to creation. Analogy among characters is not the only structural device which blurs the boundaries of the self. The very repetition of the act of narration, involving a chain of quotations, makes the story a perfect example of what Jakobson calls "speech within speech"1 and divorces the various characters from their own discourse. In addition to the real author's speech to the real reader, crystallized in that of the implied author to the implied reader, the whole story is the speech of an (...) extradiegetic-heterodiegetic narrator who, in the footnote, calls himself "editor" and who sums up Liddell Hart's account and juxtaposes it with Yu Tsun's dictated statement. Just as the editor quotes Tsun, so Tsun, an extradiegetic-homodiegetic narrator, quotes Albert who in turn quotes Ts'ui Pên, sometimes verbatim, as in the case of the crucial letter, sometimes by conjecture, as in the instance of Pên's supposed declarations about the book and the maze. Quotation, then, is a dominant narrative mode in this story, and quotation is the appropriation by one person of the speech of another. Since a person is to a large extent constituted by one person of his discourse, such an appropriation implies, at least partly, an interpenetration of personalities. Thus both repetition through analogy and repetition through quotation threaten the absolute autonomy of the self. · 1. ‘When I use a word’, Humpty Dumpty said, in a rather scornful tone, ‘it means just what I choose it to mean—neither more nor less.’In his recent note on Hipponax in this journal, Joseph Cotter first offers ‘a revised version of LSJ's definition’ of ὄρχις. At LSJ, s.v. ὄρχις I, ‘… testicle Hippon. 92.3 W. …’, he would delete the Hipponactean citation and rewrite the second definition, under ΙΙ, to read: ‘from similarity of shape, 1 glans penis, Hippon. 92, 2. (...) from the form of its root …’. Cotter derives his new definition from his reading of that Hipponactean line, καί μοι τὸν ὄρχιν τῆς φαλ[ …, which he supplements with the name of a marsh bird, φαλ[ηρίδος, also redefined. This supplementary ‘coot’ is said to mean ‘cock’, so that the narrator of the fragment's description of treatment for sexual impotence tells how a Lydian woman ‘thrashed with fig-branch the glans of my cock’. We are presented, then, with two previously unattested meanings of two nouns, ὄρχις and φαληρίς, and an accommodating correction of LSJ. What—I have asked Cotter—might Henry Liddell have thought of these innovations, familiar as he undoubtedly was with Humpty Dumpty's semantics! (shrink)
